이용약관

본 약관은 SPLITS8 운영자(이하 "운영자")가 제공하는 iPhone 및 Apple Watch용 애플리케이션 SPLITS8(이하 "서비스")의 이용과 관련하여 운영자와 이용자 사이의 권리, 의무 및 책임사항을 정함을 목적으로 합니다. 이용자는 서비스를 설치하거나 이용함으로써 본 약관에 동의한 것으로 봅니다.

제1조 (정의)

  1. ① "이용자"란 본 약관에 따라 서비스를 이용하는 자를 말합니다.
  2. ② "회원"이란 이메일 인증 또는 Apple로 로그인을 통하여 계정을 생성한 이용자를 말합니다.
  3. ③ "이용자 콘텐츠"란 회원이 서비스에 등록하여 다른 회원에게 표시될 수 있는 닉네임, 프로필 사진 및 운동 기록 요약을 말합니다.

제2조 (약관의 효력 및 변경)

  1. ① 본 약관은 서비스 내 또는 본 페이지에 게시함으로써 효력이 발생합니다.
  2. ② 운영자는 관계 법령을 위반하지 아니하는 범위에서 본 약관을 변경할 수 있으며, 변경하는 경우 시행일자 및 변경 내용을 본 페이지에 게시합니다. 이용자에게 불리한 중요한 변경은 서비스 내 공지 또는 전자우편으로 알립니다.
  3. ③ 이용자가 변경된 약관에 동의하지 아니하는 경우 서비스 이용을 중단하고 계정을 삭제할 수 있습니다.

제3조 (서비스의 내용)

  1. ① 서비스는 운동의 구간별 소요 시간을 측정·기록하고, 회원 사이에 기록을 비교할 수 있는 기능을 제공합니다.
  2. ② 서비스는 계정 없이 이용할 수 있으며, 친구 및 순위표 기능은 회원에 한하여 제공됩니다.
  3. ③ 서비스는 무료로 제공됩니다. 운영자가 유료 기능을 도입하는 경우 그 내용과 조건을 사전에 고지합니다.
  4. ④ 운영자는 운영상 또는 기술상 필요에 따라 서비스의 전부 또는 일부를 변경하거나 중단할 수 있습니다.

제4조 (계정)

  1. ① 회원은 만 14세 이상이어야 합니다.
  2. ② 회원은 자신의 계정을 직접 관리하여야 하며, 이를 타인에게 양도하거나 대여할 수 없습니다.
  3. ③ 회원은 언제든지 서비스 내(설정 → 프로필 → 계정 삭제)에서 계정을 삭제할 수 있습니다.

제5조 (이용자의 의무 및 금지행위)

이용자는 다음 각 호의 행위를 하여서는 아니 됩니다.

  1. 욕설, 혐오 표현, 음란한 표현 등 타인에게 불쾌감을 주는 닉네임 또는 프로필 사진을 등록하는 행위
  2. 타인 또는 운영자를 사칭하거나 타인의 권리를 침해하는 행위
  3. 허위의 기록을 고의로 등록하여 순위표를 왜곡하는 행위
  4. 서비스의 정상적인 운영을 방해하거나, 서비스 또는 서버에 권한 없이 접근하는 행위
  5. 그 밖에 관계 법령 또는 공서양속에 반하는 행위

제6조 (신고, 차단 및 조치)

  1. ① 운영자는 제5조를 위반하는 이용자 콘텐츠 및 이를 등록한 이용자를 용인하지 아니합니다.
  2. ② 이용자는 서비스 내 친구 화면의 메뉴(···)에서 다른 이용자를 신고하거나 차단할 수 있으며, 제13조의 전자우편으로도 신고할 수 있습니다.
  3. ③ 운영자는 신고를 접수한 때에는 지체 없이, 통상 24시간 이내에 이를 검토하고, 위반이 확인된 경우 해당 이용자 콘텐츠의 삭제, 이용 제한 또는 계정 삭제 등 필요한 조치를 합니다.
  4. ④ 차단한 이용자는 차단한 이용자의 기기에서 친구 목록, 검색 결과 및 순위표에 표시되지 아니합니다.

제7조 (건강 및 안전에 관한 고지)

  1. ① 서비스는 의료 기기가 아니며, 서비스가 제공하는 정보는 의학적 조언, 진단 또는 치료를 대신하지 아니합니다.
  2. ② 고강도 운동에는 부상 등의 위험이 따릅니다. 이용자는 자신의 건강 상태를 고려하여 본인의 판단과 책임으로 운동하여야 하며, 필요한 경우 사전에 의사와 상담하여야 합니다.
  3. ③ 심박수, 칼로리, 거리, 페이스, 횟수 등 기기가 측정하거나 추정한 값은 실제와 다를 수 있습니다.

제8조 (제3자 상표에 관한 고지)

SPLITS8은 HYROX의 공식 애플리케이션이 아니며, HYROX 및 그 권리자와 제휴, 후원 또는 승인 관계에 있지 아니합니다. HYROX는 해당 권리자의 상표입니다. 서비스가 제공하는 등급 및 기준은 서비스 자체의 기준이며 공식 기록이 아닙니다.

제9조 (지식재산권)

  1. ① 서비스 및 그에 포함된 디자인, 상표, 소프트웨어에 관한 권리는 운영자에게 귀속됩니다.
  2. ② 이용자 콘텐츠에 관한 권리는 이를 등록한 회원에게 귀속됩니다. 회원은 운영자가 서비스의 제공에 필요한 범위에서 이용자 콘텐츠를 저장하고 다른 회원에게 표시하는 것을 허락합니다.

제10조 (책임의 제한)

  1. ① 서비스는 "있는 그대로" 제공되며, 운영자는 관계 법령이 허용하는 범위에서 서비스의 무중단, 무오류 또는 특정 목적에의 적합성을 보증하지 아니합니다.
  2. ② 운영자는 운영자의 고의 또는 중대한 과실이 없는 한, 서비스의 이용 또는 이용 불능, 기록의 손실, 운동 중 발생한 부상과 관련하여 이용자에게 발생한 손해에 대하여 책임을 지지 아니합니다.
  3. ③ 본 조의 어떠한 내용도 관계 법령상 배제하거나 제한할 수 없는 책임을 배제하거나 제한하지 아니합니다.

제11조 (이용 제한 및 해지)

운영자는 이용자가 본 약관을 위반한 경우 사전 통지 없이 해당 이용자의 서비스 이용을 제한하거나 계정을 삭제할 수 있습니다.

제12조 (준거법 및 관할)

본 약관은 대한민국 법령에 따라 해석되며, 서비스와 관련하여 운영자와 이용자 사이에 발생한 분쟁에 관한 소송은 「민사소송법」에 따른 관할 법원에 제기합니다. 다만, 이용자의 거주지 법령이 소비자에게 부여하는 강행적 권리는 영향을 받지 아니합니다.

Terms of Use

These Terms of Use (the "Terms") govern your use of the SPLITS8 application for iPhone and Apple Watch (the "Service") provided by the operator of SPLITS8 (the "Operator", "we", "us" or "our"). By installing or using the Service, you agree to be bound by these Terms.

1. Definitions

  1. 1.1 "User" means any person who uses the Service under these Terms.
  2. 1.2 "Member" means a User who has created an account by email verification or Sign in with Apple.
  3. 1.3 "User Content" means the nickname, profile photo and workout summaries that a Member submits to the Service and that may be displayed to other Members.

2. Effect and Amendment

  1. 2.1 These Terms take effect upon publication within the Service or on this page.
  2. 2.2 The Operator may amend these Terms to the extent permitted by applicable law. Amendments will be published on this page together with their effective date. Material changes adverse to Users will be notified within the Service or by email.
  3. 2.3 If you do not agree to the amended Terms, you may stop using the Service and delete your account.

3. The Service

  1. 3.1 The Service measures and records split times of workouts and allows Members to compare results with one another.
  2. 3.2 The Service may be used without an account. Friend and leaderboard features are available to Members only.
  3. 3.3 The Service is provided free of charge. Should paid features be introduced, their content and conditions will be notified in advance.
  4. 3.4 The Operator may modify or discontinue all or part of the Service for operational or technical reasons.

4. Accounts

  1. 4.1 Members must be at least 14 years of age (13 in the United States, or such higher age as your jurisdiction prescribes).
  2. 4.2 You are responsible for your account and may not transfer or lend it to any other person.
  3. 4.3 You may delete your account at any time within the Service (Settings → Profile → Delete account).

5. Prohibited Conduct

You shall not:

  1. submit a nickname or profile photo that is abusive, hateful, obscene or otherwise objectionable;
  2. impersonate any person or the Operator, or infringe the rights of others;
  3. knowingly submit false records in order to distort leaderboards;
  4. interfere with the normal operation of the Service, or access the Service or its servers without authorization; or
  5. otherwise act in violation of applicable law or public order.

6. Reporting, Blocking and Enforcement

  1. 6.1 The Operator has no tolerance for User Content that violates Section 5 or for Users who submit it.
  2. 6.2 You may report or block another User from the menu (···) on the Friends screen of the Service, or report by email to the address in Section 13.
  3. 6.3 Upon receipt of a report, the Operator will review it without delay, ordinarily within 24 hours, and, where a violation is confirmed, will take appropriate measures including removal of the User Content, restriction of use or deletion of the account.
  4. 6.4 A User you have blocked will not appear in your friend list, search results or leaderboards on your device.

7. Health and Safety Notice

  1. 7.1 The Service is not a medical device, and the information it provides is not a substitute for medical advice, diagnosis or treatment.
  2. 7.2 High-intensity exercise involves a risk of injury. You exercise at your own discretion and risk, having regard to your own state of health, and should consult a physician beforehand where appropriate.
  3. 7.3 Values measured or estimated by the device, including heart rate, calories, distance, pace and counts, may differ from actual values.

8. Third-Party Trademarks

SPLITS8 is not an official HYROX application and is not affiliated with, sponsored by or endorsed by HYROX or its rights holder. HYROX is a trademark of its respective owner. Grades and standards shown in the Service are the Service's own and do not constitute official results.

9. Intellectual Property

  1. 9.1 All rights in the Service, including its design, marks and software, belong to the Operator.
  2. 9.2 Rights in User Content remain with the Member who submitted it. You grant the Operator permission to store User Content and display it to other Members to the extent necessary to provide the Service.

10. Limitation of Liability

  1. 10.1 The Service is provided "as is". To the extent permitted by applicable law, the Operator gives no warranty that the Service will be uninterrupted, error-free or fit for a particular purpose.
  2. 10.2 Save in the case of wilful misconduct or gross negligence on the part of the Operator, the Operator shall not be liable for any loss arising from the use of or inability to use the Service, loss of records, or injury sustained during exercise.
  3. 10.3 Nothing in this Section excludes or limits any liability that cannot be excluded or limited under applicable law.

11. Suspension and Termination

Where a User breaches these Terms, the Operator may restrict that User's use of the Service or delete the account without prior notice.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Korea. Any dispute between the Operator and a User in connection with the Service shall be brought before the court having jurisdiction under the Civil Procedure Act of Korea. Mandatory consumer rights under the law of your place of residence remain unaffected.
